This Guide and Checklist detail the federal law and Supreme Court history relevant to Tribal court jurisdiction to enforce tribal protection orders issued against non-tribal members. It also contains a checklist for tribal advocates that suggests topics and issues for advocates to discuss with survivors when filing or drafting a tribal protection order against a non-member. The checklist includes the requirements for a protection order to be given full faith and credit under the Violence Against Women Act to be enforceable in any U.S. state, Tribe, or territory.
