Sentencing, Resentencing and Post-Conviction Relief Laws for Criminalized Survivors
Prisons and jails across the United States are filled with criminalized survivors - survivors of gender-based violence (GBV) who have been punished by the criminal legal system for acts they took to survive and protect their children. Over the past several years, remedial legislation has been introduced and passed in several states. These laws are intended to give survivors relief from unjust judgments and harsh sentences, and to ensure that defendants' experiences of abuse are considered at sentencing. The National Defense Center for Criminalized Survivors offers this compilation of sentencing, resentencing and other post-conviction relief laws applicable to criminalized survivors’ efforts to get relief following conviction.
